Acceptable Use Policy

1. Overview

This Acceptable Use Policy ("AUP") applies to everyone who uses HercuList MagicBox, including pages published to themagicbox.ai. It is part of, and incorporated into, our Terms of Service. Capitalized terms have the meanings given in the Terms. We may update this AUP at any time. If you violate this AUP, we may remove Content, take down Pages, and suspend or terminate accounts, in our discretion and without notice where we deem it appropriate.

You are responsible for all Content you create, generate, publish, or distribute through the Service, and for all activity under your account.

2. Prohibited Content

You may not create, publish, host, link to, or distribute Content that:

Is illegal, or promotes, facilitates, or provides instructions for illegal activity.
Sexually exploits or endangers minors in any way. This is strictly prohibited and will be reported to the appropriate authorities.
Is pornographic, sexually explicit, or otherwise adult content, where prohibited by us or by law.
Is hateful, harassing, threatening, or incites violence or discrimination against individuals or groups.
Infringes any patent, trademark, trade secret, copyright, publicity, privacy, or other right of any third party, including using others' images, logos, or written material without permission.
Is deceptive, fraudulent, or misleading, including fake offers, false scarcity, impersonation of a person or brand, or "get-rich-quick" schemes.
Phishes for credentials or personal data, distributes malware, or attempts to compromise devices or accounts.
Constitutes spam or unsolicited bulk messaging, or drives traffic to any of the above.
Promotes unlawful pyramid schemes. (Lawful participation in the MagicBox referral program, as described in the Terms, is permitted.)
Makes unsubstantiated or misleading health, medical, financial, earnings, or investment claims, or offers regulated products or services without required authorization or disclosures.
Sells or promotes weapons, illegal drugs, counterfeit goods, or other prohibited or regulated items where not lawfully permitted.

3. Prohibited Conduct

You may not:

Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
Circumvent, disable, or interfere with security features, quotas, tier limits, or rate limits.
Access, scrape, or harvest data from the Service by automated means except as we expressly permit.
Manipulate, falsify, or game Swaps ratings, reputation, referral attribution, or usage metrics.
Resell, sublicense, or provide the Service to third parties except as expressly permitted.
Use the Service to compete with, reverse engineer, or build a substantially similar service.
Overload, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure.

4. Lead Capture and Email Rules

If you use Capture Pages or otherwise collect contact information through the Service, you must:

Collect information only with proper notice and any legally required consent, and only for lawful, disclosed purposes.
Not use purchased, rented, scraped, or otherwise non-consensual contact lists.
Present accurate, non-deceptive offers and honor what you promise to subscribers.
Comply with all applicable laws, including anti-spam and telemarketing laws (for example, CAN-SPAM, CASL, TCPA, and GDPR where relevant), and honor opt-out and deletion requests.

5. Enforcement and Takedown

Published pages include a mechanism to report abuse. We review reports and may act on them, but we do not guarantee any particular response time or outcome. We may, at our discretion: remove or disable access to Content; display a placeholder in place of removed Content; hard-delete Content that violates this AUP or the law; suspend or terminate accounts; and cooperate with law enforcement.

Content removed for policy or legal reasons may be permanently deleted without the placeholder used for ordinary un-hosting, and without prior notice.

6. Reporting Abuse

To report Content or conduct that may violate this AUP, use the "Report" link on a published page or contact herculist@herculist.com. Please include the URL and a description of the issue.
